I can hear the screaming about "judicial activism" and "atheists in black robes" already. This issue may do for republicans what it did in '04. Bring out the base who might have stayed home otherwise. In '04 it was done by putting amendments to state constitutions on the ballots. That trick can't be repeated so this time it will have to be a candidate who associates himself with the homophobic agenda. I'm pretty sure that means the issue will only play for Romney. In fact it may come into play in his nomination strategy.
