If it were that simple Nero would have done it a long time ago. Consider the analogy to the Romans of that time having only one neck.
Besides, what do you do when it is institutionalized? According to one viewpoint of Constitutional doctrine, anything repugnant to our Constitution is null and void from its inception. So, how did we get a drug war that has no Constitutionally delegated authority since the repeal of that power by the 21st Amendment? I picked this as a simple example.
From another perspective, I am of the opinion that the military should have refused to unconstitutionally (i.e. follow unlawful orders to) prosecute a common Offense, without a formal declaration of war against a lawful sovereign state.
