This is just fucked. Some guy decides to help out some friends, a lesbian couple, conceive. Some years later, the two women split, and now the guy who donated his sperm is hit for child support.

The donor is now dead (from a stroke), so the case seems to be in limbo. Still, it's pretty fucked up that something like this could even happen...

I agree with you, proUSA. Though I probably wouldn't donate sperm in the first place due to issues of this nature, I don't think the man should be liable to pay child support for a child that is really not his, not legally at least, not in my book.

That's like saying I should be paying for shampoo if I donate my hair to Locks of Love. Absurd.

I have to agree with the court on this one.

This is not a case of an ordinary sperm donor at all. In fact, he really wasn't a mere donor, and the evidence supports the fact that he acted as the children's father beyond merely providing sperm for another couple to have children for themselves alone.

The biological father conceived more that one child with the lesbian couple. He also provided voluntary financial support, toys and clothing, and he sought and received plenty of visitation with the children. The children called him "Papa." But, then he sought to avoid child support by claiming he was only a mere sperm donor. IMO, that dog won't hunt.

As the court said: "Such constant and attentive solicitude seems widely at variance with the support court's characterization of (him) having 'played a minimal role in raising and supporting' the children."

In reality, the biological father was a raising father to the children. The lesbian couple and him made a deal to have the children for all of them to enjoy and raise. Thus, he was no mere 'sperm donor' as he would have had the court believe.

He wanted it both ways however it suited him, and the court rightly said no dice. When it comes to sperm and egg donation, the donor must be either 'in' or 'out' on whether he or she becomes a parent to the offspring.

The things you mentioned are what I found troubling about this case. If he didn't want to pay child support, he shouldn't have played the role of father, nor should he have done an "in-home" type donation to help out his "friends".

The real tradgedy in this case is that a child has 2 mommies. Lesbian couples raising a kid are being horribly irresponsible to the child.
