Umm, the 10th Amendment has essentially been thrown out the window in the past century with the massive increase in the size of the federal government. Sure, it may be unconstitutional, but SCOTUS will never rule on it that way, and no sane lawyer will bring up such a contention. At this point, it's simply bad law.

frankly its a tangle. When the states started accpeting fed,. funds for schooling etc. they opened this door. Do I think NCLB is good ? yes no and maybe....

No individual can plan his own existence in their view. So the state planners must arrogate to themselves the right to manipulate any sector of the economic system if the good of “society” or the “general welfare” is paramount. Of course, I also think my state govt should stay out of it too. Let the cities and communities decide how best to educate their children. And beyond that, my children will never be educated by the govt. I may still have to pay for the govt to educate everyone elses children, but I still have control over my own at least.
