The Creative Steps Day Camp paid more than $1900 to The Valley Swim Club. The Valley Swim Club is a private club that advertises open membership. But the campers' first visit to the pool suggested otherwise.

"When the minority children got in the pool all of the Caucasian children immediately exited the pool," Horace Gibson, parent of a day camp child, wrote in an email. "The pool attendants came and told the black children that they did not allow minorities in the club and needed the children to leave immediately."

The next day the club told the camp director that the camp's membership was being suspended and their money would be refunded.

"I said, 'The parents don't want the refund. They want a place for their children to swim,'" camp director Aetha Wright said.

Campers remain unsure why they're no longer welcome

Not sure how that works out, exactly. I'd imagine you're right, as a private club they can be as racist as they want.

I don't actually know how this works, as a matter of legal considerations, but I am familiar with it anecdotally. Where I grew up, there were a lot of private golf country clubs (I caddied at one) that catered to wealthy people in the area. They seemed to segregate themselves by religion, for the most part, but also with race restrictions. There were Jewish ones, Catholic ones, Protestant ones, and I think all of them only allowed Caucasians. I seem to recall that Michael Jordan was declined membership at one when I was growing up (he lived in my home town at the time).

I'm not an expert on the law involved, but I think that there might be more at stake for a business open to the public than just the negative PR that would be associated with discriminating on race/religion. That is, I think private clubs can get away with it because they don't cater to the public, whereas your local CVS can't hang a sign outside that says "no Chinese allowed".

That's what I'm trying to work out, if your company/business/club caters to the public, are you then forced to abide by non-discrimination laws? As in, if I opened "Speakeasy's Sub Shack", could I be sued for denying service to Mongolians? After all, the restaurant would be privately owned by me.

I know that McDonalds or Pizza Hut could be sued for discrimination (and they have been), so what legally separates them from my hypothetical sub shack, if anything? They're not owned by the government...

right. thats what the private part was about. in the civil rights act it says no public business nor government entity may discriminate on basis of race, gender, religion, and sexual identity as well iinm. however "private clubs" and i think businesses are specifically excluded.
and since this was specifically mentioned as a private club in the article, well... its racist but not illegal
