Disgusting. Adds insult to injury. Its not free speech to demean a dead solider and it should be illegal. These are the people who stand outside soldier funerals with "God hates fags" and "Thank God for dead soldiers" posters. Is there anyone here who here thinks they should have a right to engage in such despicable acts?

well theoretically they should be able to say whatever they want etc etc etc ad nausem. however in reality picketing a funeral of a soldier who's returned on his shield, and demeaning his sacrifice causes pretty violent reactions in most people in the funeral. Therfore they're disturbing the peace and therefore they can sit the fuck down and shut the fuck up before they get tased for inciting a riot.

I wonder why people don't picket Westboro Church with signs and placards saying "Gods hates incestuous r'ships"; and "God hates those who use hate to promote their incestuous form of 'family' love"? Fred Phelps and his in-bred family (and on that, I'm not joking) are an offense to oxygen breathers everywhere.

The church is led by one man, Frederick Phelps, who is a disbarred lawyer in the state of Kansas. Obviously his delusional brain function has slowed at this point in his life (age 78). He has his own band of followers, most of which are directly related to him. His church has a confirmed 71 members, 60 are related either by blood, marriage, or both. This goes to say that he is not against incest or inbreeding, since he does not allow them to marry outside the church.

Westboro is the worst of the worst subhuman slime ever to infect this country.

The 4th circuit needs to have their heads examined.

It is free speech. Tasteless and disgusting but it is the expression of an opinion and therefore protected free speech unless they are inciting violence or crossing the lines of other reasonable limitations on free speech.

I'm not so sure about that.

Maybe OSB can chime in, but I believe that certain speech, if used to elicit a specific response, can be deemed not to be protected. Like yelling "FIRE!" in a crowded movie theatre; it's illegal to do that. Someone doing that knows what the reaction is likely to be.

In the case of the human piece of shit that is Phelps, if his speech can be expected to create a certain reaction, it could be deemed to be not protected.

Again, however, I'm not certain, and would ask that our resident legal Maharishi opine on the matter...

There is room for a debate if the actions of the group fall under incitement to violence restrictions on free speech.

However I think that incitement to violence would be in the form of “Kill all of them now!!” type of statements, not “Come and beat the shit out of me if you disagree with me”.

The irony is that the Marine died to protect the freedoms of Americans and yet people want to deny the church group the very freedoms that the Marine died defending.

You can honour his sacrifice by honouring the freedoms that he died for.
