Smith versus Maryland has been upheld 4 times since the 70's by the federal supreme court. It specifies that you have NO RIGHT TO PRIVACY regarding your PHONE LOGS, which can be, and ARE gathered by anyone and everyone.

The "Wiretapping" case is merely a gathering of PHONE LOGS which are placed into a database and analyzed. If call logs show that the phone call went to or was from an overseas number that could in any way be construed as suspect, then a FISA warrant was issued and that number was THEN, LATER SUVEILLED for future calls.

This case will lose lose lose regardless of how much they rant rant rant.

There was no "WIRETAPPING" there was no "ILLEGAL SURVEILLANCE"

That is smoke blown by the left for so long that it is regurgitated daily.

What this is about is the Federal Government getting PHONE LOGS from the Telecommunications company (I am a systems analyst / Developer for one of those, by the way) "Without warrant"

Well, just like for you and me, there is NO RIGHT TO PRIVACY fro your phone logs. In fact, for about $20, I can get all your logs from the last 5 years so long as I have a correct name which was/is tied to a correct, working number.

When this came out, a blogger paid for and received the phone logs for a year FOR THE CHAIRMAN OF THE JOINT CHIEFS OF STAFF. He did it to TRY to prove a point...the Feds broke NO LAW by the gathering of the logs.

There is NOT ONE Case that ANYONE Can note that involves the actual WIRETAPPING or AUDIO SURVEILLANCE of telephone calls WITHOUT a FISA warrant.

This is about "gathering phone logs without FISA or a warrant of any kind."

Tough titty. They are fair game and it has been upheld 4 times, the last time in 2002.
