I don't think they did, but this program was so FUBAR that it would not have mattered. It is well documented that field agents watched guns being smuggled across the border, but were expressly forbidden from interdicting the smuggling and arresting the smugglers. It isn't that the ATF could not find these guns before they left the country, but rather that a decision was made high up in the ATF (or even higher in the administration) to deliberately let them go.
As for executive privilege, my understanding is that it only applies when the President gets advice from counsel or his administration members. Which means that President Obama was aware of the program. That means that the Attorney General lied under oath before Congress, and that the President lied to us (I know, big surprise).
