Rental car damage waiver and who should pay

Fact: Insurance companies will not pay for an auto rental companies "damage waiver" for the injured parties rental car even when their insured is the "at fault party" even 'tho they pay for the car rental.

Fact: The injured parties insurance company may become involved in the incident but the insurance may or may not completely cover their insured for costs to cover any loss or damage to the rental vehicle because of terms in the rental car contract.

IMO: The at fault driver who put the injured party in position to need a rental car should through his/hers insurance should shoulder the expense so as not to place the injured party in harms way due to no fault of his own. and further eliminate the potential mark against the injured party caused by including his insurance company in the transaction.
