Well, technically, kangaroos are endangered in California. Their natural population there has dwindled quite a bit.

Does it say in the Californian Endangered Species Act that kangaroos are to be seen as endangered? In that case, the statute is stupid.

If the Act does not say "kangaroo" but the plaintiff convinced the court kangaroos are endangered, then it is not a stupid statute but sloppy work of the defendant.

That's an interesting comment, considering that crocs in Australia are far more endangered than kangaroos. All 'round it seems like a very poor defense case, and a poor judgement made accordingly.
