Re: Hit The Road, Elvira...

Woman sneaks over the border. Meets guy - a citizen - in a bar. They have sex. They successfully (albeit unintentionally) conceive. What is the status of the child?

Edit - this is for Tamperpr00f

Tnx.
That is a rough one. Off the cuff, If it was me, I would say the citizenship of the child would depend upon the citizenship of the mother.

Re: Hit The Road, Elvira...

Interesting.

I think it's a remarkably difficult question. My perspective is that (given that she doesn't opt for abortion) the born child is equally both parents'. This makes things hard, doesn't it?

Yes. Maybe a better answer would be that the child has the citizenship of the parent who is going to raise it.

I think the issue was hard before the conception.

Seriously a friend of mine has a father who is a US citizen and a mother who is Albanian. He has dual citizenship. His parents are married and his mother is not a US citizen so that may change the issue but I am pretty sure if you can prove one of your parents a citizen you are a citizen.

Elvira spoke in front of her government today (the Mexican government, that is). Here is what she said:

"The United States is the one who broke the law first, by letting people cross over without documents, by letting people pay taxes. It has been very hard; [crying while someone pats her back in sympathy] but I am not alone."

Amazing.

Typical.

They'll blame anyone they can before accepting the blame themselves. And, even if what she said was true, it doesn't absolve her from her own wrong-doing...

Re: Hit The Road, Elvira...

Ummm what did I miss? We LET her commit a crime? 2 times and we LET her steal someones identity?

I suppose we are LETTING people murder each other so we can throw them in jail too.

Wow! So i guess I'm at fault if someone breaks into my home and steals my stuff because I "let" him do it.

Guess the US just has to accept that it is an attractive nuisance and let all the illegals in who wish to come, and be responsible for anything which befalls them once they are here.

That's got to be one of the stupidest things I've ever heard. That's on par with the urban legend about a burglar suing a homeowner after hurting himself climbing through a window....
