Today, Ranking Member of the House Ways and Means Committee Dave Camp (R-MI) released a letter from the non-partisan Joint Committee on Taxation (JCT) confirming that the failure to comply with the individual mandate to buy health insurance contained in the Pelosi health care bill (H.R. 3962, as amended) could land people in jail. The JCT letter makes clear that Americans who do not maintain “acceptable health insurance coverage” and who choose not to pay the bill’s new individual mandate tax (generally 2.5% of income), are subject to numerous civil and criminal penalties, including criminal fines of up to $250,000 and imprisonment of up to five years.

In response to the JCT letter, Camp said: “This is the ultimate example of the Democrats’ command-and-control style of governing – buy what we tell you or go to jail. It is outrageous and it should be stopped immediately.”

Key excerpts from the JCT letter appear below:

“H.R. 3962 provides that an individual (or a husband and wife in the case of a joint return) who does not, at any time during the taxable year, maintain acceptable health insurance coverage for himself or herself and each of his or her qualifying children is subject to an additional tax.” [page 1]

“If the government determines that the taxpayer’s unpaid tax liability results from willful behavior, the following penalties could apply…” [page 2]

“Criminal penalties

Prosecution is authorized under the Code for a variety of offenses. Depending on the level of the noncompliance, the following penalties could apply to an individual:

• Section 7203 – misdemeanor willful failure to pay is punishable by a fine of up to $25,000 and/or imprisonment of up to one year.

• Section 7201 – felony willful evasion is punishable by a fine of up to $250,000 and/or imprisonment of up to five years.” [page 3]

When confronted with this same issue during its consideration of a similar individual mandate tax, the Senate Finance Committee worked on a bipartisan basis to include language in its bill that shielded Americans from civil and criminal penalties. The Pelosi bill, however, contains no similar language protecting American citizens from civil and criminal tax penalties that could include a $250,000 fine and five years in jail.

“The Senate Finance Committee had the good sense to eliminate the extreme penalty of incarceration. Speaker Pelosi’s decision to leave in the jail time provision is a threat to every family who cannot afford the $15,000 premium her plan creates. Fortunately, Republicans have an alternative that will lower health insurance costs without raising taxes or cutting Medicare,” said Camp.

According to the Congressional Budget Office the lowest cost family non-group plan under the Speaker’s bill would cost $15,000 in 2016.

This is the reason why the townhallers and what-not made such a stink about our congress critters, not being in a rush and taking the time to read the bill because there might be landmines like this.

This regime is in power through their lies, and only through lying… no American voter would vote for anyone that dared to run on anything close to what these people are doing… and if anyone on this planet, or any other planet, needed more truth… this ONE clause tucked away in just one bill should be more than enough to prove it.

Now this is the kind of shit where I can ardently get behind the people who don't want this kind of healthcare reform.

How about we don't mandate people buy coverage, how about we mandate insurance companies offer insurance without consideration of pre-existing conditions, and if they discriminate based upon pre-existing conditions we send their entire top 3 levels of executive management (including the board of directors) to prison for 5 years? Thats the kind of insurance reform I could also get behind.

Not sure if this part of it is true, but I hear that the bill in it's current form still won't cover 2/3 of the uninsured? - WTF!

Wasn't that the main reason for passing "universal heath care."

Someone correct me on this if I'm wrong.

JoMe: yes, you’re correct about 2/3 of those not insured now still won’t be after this POS becomes law.

But that was never the point: the only point of all this is control. Nothing more.

Control over 15% of the economy
Control over the people.

This is how it works… they want nothing less than total control.

Please look up insurance in the dictionary. Insurance is to cover the cost of possible future loss. Health insurance's purpose is not to provide health care, but to pay for it. The next time you get a dent in your car, try switching auto insurance companies before you file a claim. Then try to get your new company to cover your preexisting dent.
I can't afford to both eat AND pay 15 grand for health insurance. I guess I'm going to jail too.

Lets hope the breaking point is near and the American sheeople snap and take action.

I agree with you on the preexisting thing. I don't think it's right to deny people care. However, I don't think anyone in the insurance company should go to jail, if they do deny for that reason. The company should just be handed a hefty fine that would make covering the "broke" person the viable option. I also don't believe that a company should be able to drop someone, either.

I am not a car. I can't get a new me every 5 to 10 years. I have but one body in this life. If I developed something that needs constant care, and can't get insurance coverage, I am doomed to be either broke or have my ailments overcome me (unless somehow I become a multi-millionaire). This is one instance where I think regulation is legit.
