Again, I Fail To See A Problem...

So some guy in Michigan has decided it would be a good idea to sue in order to display a nativity scene on public property:

Dude In Michigan Sues

One statement from the guy I particularly like is this one: "I am disappointed the Road Commission would not stand up for our community and our Constitution and that is why I was compelled to file this lawsuit".

Is that all it takes now for someone to file a lawsuit in this country? "Disappointment"? I wonder what part of the Constitution he's referring to. Anyone have any idea?

Anyway, it's pretty clear that, despite the thing being erected every year for a long time, it shouldn't have been. No formal permit had ever been granted.

This will most certainly draw out the cries of “HATERS” by the usual suspects here, but it will do so without those whining about it providing anything that might back up their contention that it should be permitted. A “tradition” of this type; a religious display on public property, isn’t protected under the Constitution.

The guy should put the nativity on church grounds, or in his front yard. Everyone will still be able to see it, and there will be no question as to whether or not it can remain. But public property should not be used for this…

lawsuit is crazy but the county office was wrong also.

In March, he received a formal denial of his petition to erect the nativity scene because, according to county officials, it would be a violation of the First Amendment, which prohibits government from making laws "respecting an establishment of religion."
There was no making of a law....it was simply a permit which non-believers can be granted also.

so IMO, both partys are at fault.
