This is truly a case of stupidity on the court's part and mockery on the applicant's part. I have very little respect for an atheist who acts like an asshole and this guy is definitely one.

I think this is funny but I think it's also kind of ridiculous that the courts are so lacking of any common sense that money was wasted on bringing it to court.
BBC News - Austrian driver allowed 'pastafarian' headgear photo
An Austrian atheist has won the right to be shown on his driving-licence photo wearing a pasta strainer as "religious headgear".
Niko Alm first applied for the licence three years ago after reading that headgear was allowed in official pictures only for confessional reasons.
Mr Alm said the sieve was a requirement of his religion, pastafarianism.
Later a police spokesman explained that the licence was issued because Mr Alm's face was fully visible in the photo.

It is funny in a way but at the same time, atheists like him are aggravating because of their disrespect. We have a few on here that are like this guy and we have/had a few who I enjoyed conversing with because they can present their case without mocking with things like "imaginary friend", "psychological problem if you believe", etc. People who do that are simply jerks and not worth dealing with.
