Well, we knew she was at least somewhat rational at that point - I was easily twice the size of my partner. Unfortunately, abandonment is a felony. Leaving her would have ment I'd go to jail.

Interesting. What about mistaken ID or something like that? I.e. if you have the wrong person or something, forcing someone down to hospital to get their stomach pumped can be a huge inconvenience to someone who doesn't need it. If they say "No i haven't taken any pills you have the wrong person or something" would you still take her anyway?

Yep. She actually tried to tell us that. She gets to go, regardless.
There was other evidence to indicate that the claim was legitimate. Hell, try to say "I don't wanna go" when you're drunk and see how far that gets you. Implied consent is a handy thing sometimes.

Oh right so she was drunk too? So say hypothetically some person said it wasn't them but if you really wanted them to go to hospital they'd go anyway would you still take them?
Would getting your stomach pumped be painful? If yoy do get the wrong person i assume they would be very pissed off... |

Where I worked, the police were the ones who would compel a patient to go if they did not want to. It required probable cause to believe that the person was a danger to themselves or others based on their mental status.

Well, part of it was that we were given the authority to place people on 72 hour mental health holds (by proxy). Basically, we could call a doc and say "I'm putting this person on a hold." Their rights? Gone.
Kind of scary to think about now.

Fortunately, the lawsuit has been dropped and the Sgt. suspended indefinitely.
I still cannot believe she brought the lawsuit in the first place. Pure idiocy. Matt
