Re: Call 911 for help - and get sued

One of my favorite calls of my career - get called on a woman who was witnessed ODing on pills. That's a guaranteed trip to the ER, no questions asked, no opportunity to say no (under implied consent laws). I stand arguing with this woman for about 5 minutes. I've got my partner with me, a half-dozen firefighters, and 3 or 4 cops. Finally, I've had enough, and tell her, "we're going now." She looks at me.

She looks at my partner.

She looks at me again.

She roundhouse kicks my partner in the thigh. Hell of a kick.

My partner and I take her down and restrain her. The cops and firefighters? Can't be bothered.

Go figure.

I think I'd consider leaving her to die.

LOL

Well, we knew she was at least somewhat rational at that point - I was easily twice the size of my partner.

Unfortunately, abandonment is a felony. Leaving her would have ment I'd go to jail.

Interesting. What about mistaken ID or something like that? I.e. if you have the wrong person or something, forcing someone down to hospital to get their stomach pumped can be a huge inconvenience to someone who doesn't need it. If they say "No i haven't taken any pills you have the wrong person or something" would you still take her anyway?

Re: Call 911 for help - and get sued

Yep. She actually tried to tell us that. She gets to go, regardless.

There was other evidence to indicate that the claim was legitimate.

Hell, try to say "I don't wanna go" when you're drunk and see how far that gets you. Implied consent is a handy thing sometimes.

Re: Call 911 for help - and get sued

Oh right so she was drunk too? So say hypothetically some person said it wasn't them but if you really wanted them to go to hospital they'd go anyway would you still take them?

Would getting your stomach pumped be painful? If yoy do get the wrong person i assume they would be very pissed off...

Where I worked, the police were the ones who would compel a patient to go if they did not want to. It required probable cause to believe that the person was a danger to themselves or others based on their mental status.

Yeah that makes a lot more sense. I guess the laws in CO are more stringent.

Re: Call 911 for help - and get sued

Well, part of it was that we were given the authority to place people on 72 hour mental health holds (by proxy). Basically, we could call a doc and say "I'm putting this person on a hold." Their rights? Gone.

Kind of scary to think about now.

Let's see if I understand his argument - Sgt. Eichorn had no way of expecting that the floor could be wet when responding to a drowning?

Seriously, WTF? I guess the family should have stopped CPR to clean up before calling 911 to make sure someone idiot who wouldn't expect to find water on the floor at a drowning call didn't slip?

This is happening in my county. Please, Dear Lord, let me get picked for the jury......

Can the Court order a flogging for the Plaintiff and her lowlife ambulance chasing lawyer as part of an order dismissing the suit?

Matt
Perhaps John Edwards will become lead council for the defendent so he channel his powers for the revived victim and walk, talk and even swallow for the boy.

Re: Call 911 for help - and get sued

Fortunately, the lawsuit has been dropped and the Sgt. suspended indefinitely.

I still cannot believe she brought the lawsuit in the first place. Pure idiocy.
