It's good that the case was dropped and she lost her job, but I'm still dumbfounded by the whole situation. Now I have no formal rescue training, but every class and lesson I've had on first aid starting with cub scouts all the way up through my Red Cross CPR certifications always began by stressing the same thing: Check the scene before doing anything else. Make sure you keep yourself safe, otherwise you are useless and can become another victim. I don't think I'm going out on a limb here in guessing that day one of any formal EMT training covers the same thing.

I'd agree, I did a four day St Johns ambulance first aid course to become a first aider in my workplace. over and over it was drummed into us that you assess the situation and make sure you are safe, there's no point just becoming another part of the problem. Now that was only a couple of years ago so it's still very much part of current training for other organisations I would imagine

Our society has come accept and even to thrive on these suits. (I guess I mean that many people tend to wonder who they can sue at any given point during any given problem or injury)

What is the first thing you think just after witnessing say...an auto accident...(aside from wondering if the folks are ok?)

Probably: "I wonder which one will win the lawsuit?"

And that goes for everything.

My wife has been an insurance claims representative for over 10 years, licensed in 5 states as an independent agent and can consult as well....and has worked everything from water-loss and fire-claims to personal injury, liability and theft.

If anyone thinks the situation in this thread is 'atypical' ... think again.

You'd be amazed at what people sue for...well, actually you wouldn't be amazed, and that is what is scary.

I wish this would have been a call about a gunshot victim and when this bitch showed up they shot her too.

I'm not in any way siding with this idiot or supporting her ridiculous claim, but we just can't stop these kinds of lawsuits from happening. Anybody can sue anybody else for damned near anything. But what happens if the suit is valid? You just can't issue a blanket rule saying nobody who does something that results in injury can't utilize the system. It's for the lower courts to decide on the merits of a lawsuit.
Maybe with a penalty for bringing really ridiculous suits, but we can't say someone can't sue because of their job.

How about having the loser pay the court costs? It isn’t a perfect solution, but I think it would be a step in the right direction as far as reducing the number of frivolous lawsuits filed.

On the surface, that's a good and fair idea. The problem is we have some gray areas here.

Just because somebody loses a lawsuit doesn't automatically mean they are wrong. And if it's a suit against an entity with deep pockets, such as a corporation, would you think it fair that better and more expensive lawyering on the part of the defendant should be paid for by the loser?

I believe SOME cases can be handled that way, but not nearly all of them, and I'd hate to see some poor middle-class Joe bear the cost of some lawyer who charges a few million to win the case.

Maybe this case says more about the idiotic american tort system than that idiotic rescuer? The police department should cover the damages for that Eichhorn fool, just like a danish police department would do if one of their cops got injured on the job.

That's the way it normally works. On-the-job injuries are paid by the employer. Failing that, they can get workman's compensation.

These days, however, scumbags like her just see any excuse to get rich at somebody else's expense. If she's looking to get rich and retire early, I'm all for giving her the SECOND part...unemployment.
