Does Arlen Specter’s defection from R to D strengthen the President’s hand in Congress? Perhaps overall but not on judicial appointments because breaking (the equivalent of) a filibuster in the Senate Judiciary Committee requires the consent of at least one member of the minority. Before today, Specter was likely to be that one Republican.

Spector just hurt his democrat buddies .. without a YES by a republican in the judicial committee no nominee can get out... sweet huh? So basically unless a republican says OK, a nominee can get out of committee. So the Dem's can have 70 votes on the floor it wont matter... The only weak link is Lindsey Graham, but he can be warned he will get no republican suport in 2010 if he caves.

Before today, Specter was likely to be that one Republican.

Now this is interesting. Specter could allow a nominee out of committee if Specter was a member of the Republican minority, but as part of the majority, he’s just another vote. Here are the other Republicans: Orrin Hatch, Chuck Grassley, Jon Kyl, Jeff Sessions, Lindsey Graham, John Cornyn, and Tom Coburn.

The weak link is Lindsey Graham, who was a member of the Gang of 14. If Graham says the course, the Republicans may not be able to stop runaway spending, military retrenchment, and an interrogation witch hunt. But Specter may have handed Republicans a gift.
And how fitting that Joe Biden arranged it all by convincing Specter to switch. Thanks, Joe. I’m sure your boss will appreciate your service as he ponders who he will nominate for the Supreme Court.

If he stayed a republican he would be able to get Oabma's liberal wet dream judge out of committee then vote on the floor for her, or him and it would have been a fast appointment..

Now it will be a fight and the only hope democrats have is to get Lindsey Graham to defect... This is what democrats did to many bush Nominee's not just the SC ones.

Obama was caught flat footed again...

the republicans have to make it clear to Lidnsey.. If he caves to a liberal judge they will work againts him for reelection.

Well it was your fault for starting the second thread and then posting the same thing more than once, allbeit even if you did think it was going in seperate threads.

Anyway back on topic of Souter's possible retirement.

Its still not a certainty that he will walk away and i'm hoping he does stay on. He should have the decency to quit on the watch of a Republican.

Now we have Obamas idea of a good Supreme Court Justice. I wonder if anyone thought to ask him during the campaign?

Conservatives don't really have much to fear. Obama is going to be replacing possibly three left of centre judges with three of the same, barring one of the conservatives stepping down, which is unlikely.
