That's what I was thinking, his poll could be construed as incitement if the authorities really want to pursue it. My guess is they won't, but they could if they wanted to.

If you think "how could that be incitement", just think about a guy with a megaphone at the head of a huge crowd of demonstrators: "How many of you think we should charge through this police line and start rioting?" Crowd cheers, then charges --- that would be incitement disguised as a "poll".

Well, maybe so, but at least the right has not gone so far as to make a movie about an assignation attempt on the pres such as the case with GWB.

As I recall the conservatives didn't pay too much attention to this film because it was dismissed for the propaganda it was but imagine what the left would say if such a movie was made about BO? We would never hear the end of it. The outrage!

To charge this guy with anything you would have to PROVE the guy was planning on assassinating Obama. You would have to prove the results of the poll would be an indication of ones actions on Obama.

I know the patriot act will allow this kid to be locked up for ever but ....

Nope, "any threat to take the life of, to kidnap, or to inflict bodily harm upon the President of the United States" is criminal. The question is more whether the poll is threatening enough to warrant calling in a prosecutor (which it doesn't seem to be).
