Florida Democratic Party - the implosion continues

State party leaders have been seeking a way to have Florida's delegation seated at the Democratic National Convention.

"We researched every potential alternative process -- from caucuses to county conventions to mail-in elections -- but no plan could come anywhere close to being viable in Florida," state party Chairwoman Karen Thurman said In an e-mail sent to Florida Democrats late Monday afternoon.

Thurman said the decision now falls to the DNC Rules & Bylaws Committee, which is scheduled to meet again next month.

"Thousands of people responded," she said. "We spent the weekend reviewing your messages, and while your reasons vary widely, the consensus is clear: Florida doesn't want to vote again. So we won't."

Meanwhile, a local Democratic party activist is in federal court, suing the DNC for violating the constitutional rights of a few million Florida voters:

Atlanta (CNN) -- The Democratic National Committee is violating the equal protection clause of the 14th Amendment by allowing only four states to hold caucuses or primaries before the first Tuesday in February, a Florida attorney argued Monday before a federal appeals court.

Attorney Michael Steinberg filed suit in August on behalf of Democratic Party activist Vincent Dimaio.

The suit came after the DNC said it would not seat Florida delegates at the national convention because the state party defied party rules and scheduled its primary for January 29.

A federal judge in Florida dismissed the lawsuit in October, but Dimaio appealed.

"You can't treat the citizens of some states differently than other states," Steinberg told reporters after the hearing. "What I tried to assert is that the DNC has the right to make rules ... but the rules have to be the same for all the states."

According to party rules, only Iowa, South Carolina, Nevada and New Hampshire can schedule their primaries or caucuses before the first Tuesday in February.

Steinberg argued that the 14th Amendment, which bars states from denying individuals equal protection under the law, should prohibit the DNC from creating rules that make the votes of the residents of those four states "paramount to the rights of the voters in Florida."

While at first blush, this would appear to be moot, since the DNC is not a government entity, there is a twist - in Florida, the elections are run by the state. And the state is required to abide by the 14th Amendment.

Should be interesting.

Meanwhile, the chairwoman of the state Democratic Party reports growing dissatisfaction among Florida Democrats - and foresees the Dems losing Florida in the general election if this mess continues.

"The longer we let this linger, it clearly becomes more difficult" for a Democrat to carry Florida, she said.

Hey--this is Florida. Something we have already witnessed in 2000.

The democrat party made up a simple "butterfly" ballot, approved it, then put in out to the voters. Same ballot type, same machine & something they had done for decades prior with no problems.

All of a sudden, in 2000, their democrat voters could not find the right hole to punch, & if they did, they could not punch all the way through.

Florida should be no surprise to anyone.

In another thread about cross-over voting (Rs voting in the D primary to gain later strategic advantage) I commented that there are a lot of things wrong with out electoral system, and this is one of them.

The government doesn't decide how the captain of my volleyball team is selected. The legislature doesn't give a rodent's rumpus about when our scout meetings are held. If the ruling political parties are private entities, then what business is it of the government when/how they conduct what should be their private, internal business? And perhaps more importantly, why is the government paying all the administrative expense for them to conduct the internal matter of candidate selection? Or, if they are Not private entities, then how are we any better than the late USSR, lining up like cattle to endorse the leaders our leaders allow us to endorse?

Government should not dictate the primaries, and/or parties should reimburse the government for the costs of conducting them.
