Well, the judge threw out the sentence and he has been ordered to be released. Though he lost quiet a lot of time due to so called "justice".

Problem is, the State wants to appeal of course.

MattLarson already cited this development in the case in his post #43, Speedy...and see also the posts in reply. It appears that the boy is still in prison. Even if he gets out, ,aside from the lost time, as you rightly point out, the mud from the publicity will stick, for ever his name will be able to be searched and linked to the case, and it won't be that diffrent for him as if his name was on a register of sex offenders.

True, IIIX. And hopefully, it will work out for him. Still, the fact remains that his name would be associated with this incident forever. And this will not just affect his employment opportunities, it could also impact potential personal relationships. Yes, as you say, in some cases, people will give him a chance...but others will not. Anyway, he's not out of the woods yet.

Absolutely. And the reporting that the sentence imposed on Genarlo Wilson was “mandatory” under the law masks the discriminatory elements of the case, including the lesser probability that a white boy would have been charged with the said offence in the same circumstances.

In 2000, a 15-year-old Aboriginal boy here was imprisoned for 28 days under a mandatory sentencing regime (the 3 strikes rule) for stealing texta crayons and a can of spray paint. The boy committed suicide in custody.

The fact is that there would have been much less of a chance for a white boy to be charged for the said offence, even if he was a third time offender.

It has become more difficult today to identify cases of racism, given that outwardly blatantly racist laws have been removed from the books. It’s not to say that every case of apparent miscarriage of justice involving Blacks, Aborigines or other minorities is a case of racism. But it remains that racism can be a factor in the administration of the law and in other social practices, and there is reason to believe that racism was at play in the case of Genarlo Wilson.
