Convicted Child Killer Asks to Represent Himself at Sentencing

BOISE, Idaho — Convicted child killer Joseph Edward Duncan III told a federal judge Friday that he wants to represent himself at his sentencing hearing.

A jury is being chosen to decide whether Duncan should be put to death for the abduction and slaying of 9-year-old Dylan Groene in 2005.

"I don't have an issue with counsel personally," Duncan said in court. "It's ideological. I don't believe that they can ethically represent my ideologies."

Duncan did not elaborate on what those ideologies are. But authorities have examined an Internet blog that he kept for months before the slayings which documented his internal struggle against right and wrong, railed against the ostracizing of convicted sex offenders, and offered religious views.

U.S. District Judge Edward Lodge said he needed to make certain that Duncan was competent to waive his right to professional representation. He ordered attorneys on both sides to recommend area psychiatrists or psychologists who can evaluate him.

Duncan pleaded guilty in December to 10 federal crimes stemming from the 2005 kidnapping of Dylan and his then 8-year-old sister, Shasta Groene. Both were taken from their Coeur d'Alene home in May 2005 and sexually abused before Duncan shot and killed Dylan at a campsite in western Montana.

Duncan previously pleaded guilty in Idaho state court to killing the children's mother, Brenda Groene; her boyfriend, Mark McKenzie, and 13-year-old Slade Groene at the family home.

Jury selection for the federal sentencing phase began Monday, but Duncan told Lodge he wouldn't expect a switch to delay the trial.

If Duncan represents himself, it could put him in the position to cross-examine Shasta Groene, the sole survivor of the murders and abduction.

It is not yet clear if either side expects to call Shasta as a witness.

* This Duncan person had been previously convicted of sex offenses against children. As so often happens with these kinds of offenders, he got out ran off and reoffended. Added a few murders to the routine.

This is why we need a one strike law for this kind of sex offender. *

Its probably a scam to get his sentence overturned and tie the judicial system up for years before he finally gets executed.That little girl will most likely be a grandmother by the time that scum of society finally gets justice served to him.

As long as he is deemed mentally capable of representing himself, he does have that right unfortunately. I doubt he will have the chance to cross examine a victim especially after he pled guilty. Either way, I would imagine he is going to get death with a professional attorney or himself.

Duncan jurors don't want to view "sadistic" videotapes

BOISE -- Setting the stage for what will, no doubt, be a difficult hearing -- potential jurors in the death sentence hearing for Joseph Duncan were asked today if they could bear watching video of a child being sadistically and sexually abused.

Duncan has confessed to the murders and to kidnapping the family's two youngest children, 9-year old Dylan, and then 8-year-old Shasta.

Having some experience here, it's pretty clear to me that if he actually were to call a surviving victim into cross-examination, a child, no less, he's pretty much putting his cock in the socket, as it were. Finished. Done. Dead, most likely.

What do you think a jury reaction would be when they see a child who survived that fall to pieces when confronted with the perp?

Maybe maybe not. Only time will tell. The maddening thing about these kinds of crimes is the slow pace of the justice system. That and the fact that the justice system, in so many cases like this, has failed to keep further crimes like this from OCCURING.

This didn't need to happen at ALL. This devilish creep should have been put away for his entire life the FIRST time he sexually fiddled with a child.

This happened because he was given freedom to do it again.

Yes, well there's that and these videos of this devil sadistically molesting and probably killing the nine year old Dylan. Can you imagine being a juror in a case like this and having to watch that shit ? How can these people watch it and then later sit in the same room with this creep without immediately attempting to end him with their bare hands ?

He is playing a game with our entire justice system. I suspect he KNOWS he'll be put to death. He's wanting to make a "blaze of glory" in any way he CAN. I think he should be quietly put to death and forgotten. And the judge who previously released him can serve a life sentence for aiding these crimes that took place.
