That doesn't really add much to the case since they sued the bat company and not the purchasers of the bat or the supervisors that allowed the kids to play. The point is that aluminum bats, even if they were 10 times as dangerous, would still have a purpose even if it is for some guy who likes to hit a ball really far on his private indoor baseball field. The dangers of hitting a blunt object are obvious. It looks like they even agreed that there was nothing wrong with the product.

This is just a matter of abusing the legal system to get money. Why? Just because you can.

Well, sports are dangerous. If the kids like the sports, I don't see a problem with letting them take the risk. Life is dangerous.

Someone in the major leagues has actually been killed by a baseball. Interestingly enough, it was a pitch, and not a batted ball, that killed him. Ray Chapman was hit in the head by a pitch in 1920. He died the next day. Nobody sued the baseball manufacturer, the pitcher, or Major League Baseball.

When I played sports as a kid, my parents always had to sign a release. The organization I was playing for (either my school or Little League Baseball) could not be held liable for any injury, as sports are inherently dangerous. I suffered injuries as a result of playing sports, and the parent organizations always fully covered the medical costs (through their insurance), but nobody could get sued.

The very idea that someone needs to be warned that swinging a metal pipe could create a dangerous environment is idiotic. If the parents were unaware of that, then they were shitty parents. Pretty stupid, too.

I hope this is appealed, and I hope the bat manufacturer prevails. If they do not, then it will only be a matter of time before gun manufacturers, car manufacturers, bicycle manufacturers, knife manufacturers, etc, get sued for not "warning" people that the use of their products can cause physical harm when they are used in exactly the manner that they are intended to be used...

I can't wait for some moron to see this, get a lightbulb over his head, take a bottle of beer, sit on it, and sue Anhieser Busch for not warning him that his frosty beverage could possibly violate him.

I think that is the point. The parents didn't know. And....neither did I. What you posted about those bats not being used in the major leagues is complete news to me. I still have my late husband's metal bat which my kids never touched as they weren't much into baseball. There but for the grace of God.....

I much prefer having my son alive to having $850,000.

I have absolutely no doubt that the parents knew what the hazards were.

They're just cashing in on the fact that there was no warning on the bat and, in that, they saw a potential pay day.

My question would be this: Had the warning been printed on the bat, can the family demonstrate that the use of the bat, used as it was designed to be used, wouldn't have resulted in the exact same result? I think they should've been forced to demonstrate that...

Yes, I AM an educated woman. But at no point in my education was I instructed or tested upon the differences in wooden baseball bats and metal baseball bats. Not would I have any reason to think there would/could be a difference.

As to the family being 'forced' to demonstrate something........there are many things a family with a dead child can demonstrate. Serously doubt you would won't to see any of them though....

And thats why every baseball coach teaches the kids to catch the ball before it smacks them in the head, because if they don't it will smack them in the head. And yet even major leaguers miss once in a while.

Any parent not aware of the risk of a line drive to the forehead needs to have their surviving kids put in foster care and and get themselves locked up in the psych ward.

Oh, please.

I've never been instructed on the effects of a wood bat versus a metal bat. But you know what? I used common sense. Wood has more give than metal. It's softer. It compresses more. As such, a baseball hit by a wood bat won't travel at the same velocity as one hit by an aluminum bat.

One need not need to be instructed. One just needs to apply logic...
