What were the results for the decriminilization of pot in Nevada/ Colorado ? Did that ever pass? is pot now decriminilized/legalized?

Not here, last time I looked at the results (87% reporting as I recall) it was a 60-40 vote against the ammendment.

Hmm, how did these make it on the ballot? I thought the courts ruled a year or two back that the states couldn't make their own laws on drugs issue because it was trumped by federal ones?

The ammendment here was petitioned onto the ballot. Even if it had made it onto the Constitution, the Federal laws would have trumped the state ammendment...

How does the federal government trump state law, post the 21A? The federal government's authority to prohibit the manufacture and sale of powerful mood altering drugs was repealed by that amendment.

I do know that if you go to Tahoe and you smoke a joint on the California side, you're safe, but if you cross the street and smoke one on the Nevada side, you're flirting with disastor.

Hmm, interesting point.

The DEA ( Dumb Evil Assholes ) use the BS excuse of interstate commerce as the means to trump state law.

Not to mention that they go to the states which are voting on these issues and actually campaign against them. They use tax dollars and refuse to follow the campaign reporting laws re: reporting how much $$$ they spend.

What's the big deal? If you smoke and are not stupid about it you have nothing to worry about it. I have never met somebody that got busted that didn't do something stupid to get themselves caught. I am not in favor of drug laws at all but I don't feel that my energy is best spent on this issue.

Do they have actual statistics on interstate traffic? Many drugs can be developed intrastate, doesn't the federal government have the burden of proof?

The DEA could actually be more useful as department of the FDA (as a function of standardized weights and measures ensured by the interstate).

The idea is that they get forced to the Supreme court, which has always been reluctant to hear cases related to drugs. They want a definitive answer from the Supreme court, and honestly, finding the constitutional basis for many drug laws, especially marijuana, is a huge stretch.

South Dakota was trying to do the same thing with an abortion law.

What has been the current argument for federal authority over sovereign states rights? How are the ninth and tenth amendments being applied if not to nullify (deny and disparage) the authority of the interstate in powers not expressly granted to it by the constitution?
