If you simply assault a gay person because they are a person there is no hate crime involved.

Is the damage any different ? Getting hit with a brick hurts anyone, gettign raped hurts anyone.

Hate is now a Federal Crime. I suppose it's justified by the Commerce Clause and that old workhorse of the Left, the 14th, which has been used to justify everything from abortion to forcing a town in NC to keep "D" next to the names during elections.

Of course, I assume the Left even thinks about the constitution anymore. I may be assuming too much.

The way I see it is that a hate crime is a crime committed against someone for no other reason than they fit within some group, be it race, sexual orientation, etc...

The same one that allows including bank robberies and kidnapping.

Hate, though only recently recognized as such, is certainly a legitimate aggravating circumstance to any crime and the thought or intention of the perpetrator in committing his offense is recognized as a legitimate factor in deciding the degree of the miscreance even in the common law. The only reason you guys dislike it's classification as a factor increasing a crime so is that it's pretty much the entire basis of your politics

You know, I'm really on the fence.

On the one hand, there are already laws which can be applied to crimes.

On the other hand, if someone is ignorant enough to beat the shit out of someone simply because of the color of his skin, I think he should be hit just a little harder.

I dunno'. I don't necessarily agree with it, but I don't have major issues with it, either...
